        Full statement on Owen Farrell disciplinary
        England fly-half, Owen Farrell appeared before an independent judicial committee via video link having received a red card for an act of foul play contrary to Law 9.13 (A player must not tackle an opponent early, late or dangerously. Dangerous tackling includes, but is not limited to, tackling or attempting to tackle an opponent above the line of the shoulders even if the tackle starts below the line of the shoulders.) in the Summer Nations Series match between England and Wales on Saturday 12th August 2023.

        The independent Judicial Committee consisting of Adam Casselden SC – Chair, John Langford and David Croft (all from Australia) heard the case, considering all the available evidence and submissions from the player and his representative.

        The player acknowledged that whilst he had committed an act of foul play, he denied that the act was worthy of a red card. After reviewing all the evidence, questioning the player in detail and hearing submissions from the player’s representative, the Committee concluded that the Foul Play Review Officer was wrong, on the balance of probabilities, to upgrade the yellow card issued to the player to a red card. The Committee determined, when applying World Rugby’s Head Contact Process, that mitigation should be applied to the high degree of danger found by the Foul Play Review Officer. The Committee found that a late change in dynamics due to England #2’s interaction in the contact area brought about a sudden and significant change in direction from the ball carrier. In the Committee’s opinion, this mitigation was sufficient to bring the player’s act of foul play below the red car threshold.

        The Committee believe it is important to record, that no criticism is made of the Foul Play Review Officer nor, would any be warranted. Unlike the Foul Play Review Officer the Committee had the luxury of time to deliberate and consider, in private, the incident and the proper application of the Head Contact Process. The Committee believe this is in contrast to the Foul Play Review Officer, who was required to make his decision in a matter of minutes without the benefit of all the additional material including hearing from the player and his legal representative.

        On that basis, the Committee did not uphold the red card and the player is free to play again immediately.

        Is this a bigger political play from representatives of the SH to justify no RC and for the world to adopt 20 min RC?

            I don’t know how I can watch this game anymore. Ta’avao is a red. Porter a yellow and Farrell is…. this. I have no idea what’s going on!

            World Rugby and the RFU in particular have spent years telling us one thing then do the other.

                It is doubly shameful when you consider how many times Farrell got away with these shoulder charges before.

                Wasn't Angus Gardner the ref when Farrell clobbered Esterhuizen which sealed their win vs the Boks? Do Aussies love him?

                  I’m going to be at the WC and it will be great to enjoy it with friends, but I’ve cancelled my rugby subscription and I don’t think I’ll be restarting it. (For next year). I’ll likely only see the Ab games and those that I have tickets for.

                  Nowadays the really wow moments are getting lost in the WTF flood. I wouldn’t be a referee and they are being let down by the powers that be. Whoever wins the WC is just as likely (maybe more) to owe it to law application than talent. Neat if that is NZ, so maybe the bright side is to watch with no expectations.

                  Doesn’t feel like a great consumer product though.

                      The incident makes clear that World Rugby care more about their revenues than player welfare and natural justice.

                      If the game is going to survive, it will need a different governing body.

                                      What a joke, but to be honest are we really surprised?

                                      He has always flitted with the shoulder tackle, has supposedly improved following the tackling school...

                                          To be honest, I am almightily surprised, but was this hit as bad as the one that broke Brodie Rettalick's jaw last year that wasn't found to be red card threshold because it was somehow an absorbing tackle??
                                          I don't really like Farrell and thought he would get 6 weeks, but haven't really looked hard enough to see change of height etc anyway. I not sure if we not pissed that it's Farrell who has got off with his record or all really just concerned about safety?
